The TT Precedents Club

 

These are the rules for membership of the TT Precedents Club Facebook Group (Group). The Group is hosted by Tara Lucke. Our mission is to help Australian lawyers feel confident and supported advising on and preparing testamentary trust wills. Membership to the Group is open to participants of the TT Precedents Club (Program).

We monitor and regulate the Membership of the Group to ensure great quality of content, comment and discussion. You can find out more on our website about the Program here.  

To ensure the Group runs smoothly we have created some important rules set out below.

Rules and terms of use

Be helpful, respectful and kind

Provide genuine and helpful feedback and suggestions to others.  Ask questions.  Don’t be afraid to start a new thread. No question is too stupid.

Be supportive. Everyone in the group has different service-based businesses and experiences.

It’s fine to be a lurker if that is how you feel comfortable interacting with the group, but we love it when lots of people get involved and comment in the threads and support each other.

Trolls, defamatory, nasty, misleading, threatening and inappropriate posts will be removed. We determine, in our absolute discretion what is considered to be offensive.

No self-promotion  

No self-promotion is allowed. This group is to assist you to feel confident and supported advising on and preparing testamentary trust wills.   We reserve the right to delete any posts with self-promoted content. Repeat offenders will be removed from the group.  You may respond to a clear request for support if you believe you can assist the original poster. 

No solicitation or requests to PM you

Do not post in the group and ask people to PM you to find out more about what you offer, how you can help or to work with you. Your comments (and you) will be removed.

Do not block Group Admins

Members who block Admins will be removed from the Group.

Privacy

While this is a private Group, our community is a public place (anyone can request to enter the Group).

Do not post personal information that you would not be comfortable sharing with a stranger. We recommend that you do not post any information that may identify you or anyone else, such as your address, email address or phone number.

Don’t PM or friend-request group admins

We ask that you respect the time and privacy of our Admins and not DM them through Facebook or submit friend requests. By all means you can tag us in Group threads though.

We will reply to your email in a timely manner but if your email requires us to do some investigation it may take a little longer. 

NOTE: These rules are subject to change without notice. We might change them or people in the community are also welcome to make suggestions. The rules are here to make this a comfortable and supportive place for everyone.

Disclaimers

The written, video or sound content that is available for you on https://www.facebook.com/groups/thettprecedentsclub (the Site), including content posted by other members of the Site, and all products and services, including workshops, discussions and mastermind discussions offered by Tara Lucke and The Art of Estate Planning Pty Ltd ACN 627 545 822 as trustee for The Sunshine Trust and any associated entity (Content) is intended for general education and information purposes only.

We provide support, guidance and tools for you to improve your estate planning practice, but any advice you give to your clients, and the consequences that flow from such advice, is and remains your sole responsibility.  You acknowledge and agree that we are not responsible for decisions that you may make or advice that you give to your clients and that you will always research the correct legislation, case law and other requirements before giving such advice (Research) and that we are not involved in the Research aspect or advising your clients in any way.

In accessing and using the Content, you acknowledge and agree that:

  1. the Content is not intended to and does not constitute legal advice, tax advice, accounting advice or financial advice. If you require legal advice rather than legal information you should book in a coaching call with Tara Lucke as part of the Nexus Law Group. If you require other professional advice you should speak with an appropriately qualified professional;
  2. no lawyer/ client relationship is formed as a result of you participating in and accessing the Content;
  3. the Content is provided on as “as is, as available” basis at the time you access it;
  4. we do not warrant merchantability or fitness for a particular purpose of our Content and we disclaim all responsibility for any loss, injury, claim, liability or damage of any kind arising out of or in any way related to:

(a) any errors in or omissions from the Content, including but not limited to technical inaccuracies and typographical errors;

(b) your use of the Content;

(c) your inability to use the Content;

(d) your use of our Site or any associated third party platforms; or

5. nothing submitted to our Site or related third party platforms, including Facebook, is treated as confidential and you should anonymise all client details and consider your own confidentiality requirements with your clients before communicating with us;

6. you are an appropriately qualified Australian lawyer and note that if this is not the case, the general information provided on the Site and the Content is in no way intended to be used by you to give specific legal advice to your clients;

7. we may use third party material and advertisers at our discretion and this will not impact your use of the Content or influence your decisions relating to your use of the Content;

8. we are not responsible for failure of performance, error, omission, interruption, deletion, defect, failure to correct defects, delay in operation or transmission, computer virus or harmful component, loss of data, communication line failure, unlawful third party conduct or third party websites, or theft, destruction, alteration or unauthorised access to records;

9. we do not guarantee the accuracy, completeness or adequacy of the Content for your purposes; and

10. your use of the Content and participation in the Membership is at your own risk, with you agreeing to take full responsibility for your actions and any advice you give based on the Content and your use of the Site and other resources.

 

Limitation of liability


We shall not be liable for any damages of any kind whatsoever (including, without limitation, loss of opportunity and lawyer’s fees), resulting from or arising in connection with your use or inability to use the Content, including damages which are:

  1. special;
  2. direct;
  3. indirect;
  4. incidental;
  5. loss of profits, data or other intangibles;
  6. punitive; or

(collectively, Damages).

Our sole liability to you for Damages shall be limited to one month’s membership or $100, whichever is the greater amount.

The disclaimers, liability limitations and indemnities within these Terms do not exclude rights that by law may not be excluded.  Such rights include, but are not limited to, those rights under Australian Consumer Laws.

Indemnification

You agree to indemnify, defend and hold harmless The Art of Estate Planning Pty Ltd, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the Site and Content from and against all losses, expenses, damages and costs, including reasonable lawyer fees, resulting from any violation of these Terms by you.
