Frequently asked questions
What happens to my TT Precedents Club membership at the end of the 12 months?
We will let you know that your 12 month membership is coming to an end. You will be able to choose to renew for a further 12 months or move to a month-to-month membership at the current monthly price. If you choose to take no action, your membership will end and you won’t be charged.
Can I get access to updates that you make to the precedents?
While you’re in the initial 12 month TT Precedents Club membership period, you will receive any updates to the precedents which we release in that time.
After your 12 month TT Precedents Club membership period, precedent updates will be free if you continue on with your TT Precedents Club membership.
Do the precedents integrate with any practice management software?
The precedents are currently coded to integrate with Actionstep, Smokeball, Clio and LEAP.
How do I use the precedents if they don’t integrate with my practice management software?
The precedents are delivered as word documents with a list of variables that you can replace with client details using the Ctrl + H function (i.e. Global Replace).

Can you help me with drafting questions when using the precedents?
Yes! For the 12 months of your TT Precedents Club membership, you will get access to our will drafting clause bank plus you can submit questions to me for discussion in our weekly Thursday Hot Seats and I will draft proposed clauses for your wills or review your proposed drafting.
Can I customise the precedents after I buy them?
Yep! You will receive the templates as unprotected word documents, so you can make any changes you like to them. You can add in any additional custom coding or clauses that you like, however you will be responsible for those changes.
If you do tailor the word templates, it could make things a bit more complicated when trying to integrate future updates.
Are the precedents appropriate for all Australian States and Territories?
Yes. In particular, the wills are drafted to be compatible with all Australian States and Territories.
The most fundamental differences between each State and Territory is the enduring power of attorney/enduring guardian documents. The packages do not include enduring power of attorney/enduring guardian templates, rather you will receive a document with recommended additional powers for the financial enduring power of attorney which you can add in to your current State-based template. This template is suitable for all States/Territories other than Western Australia.
Do I get lifetime access?
Yes, you get lifetime access to the precedents and the Testamentary Trusts: The Essential Guide for Australian Lawyers course.
The precedents are purchased on an ‘as is’ basis so you will not receive updates to the precedents after your initial 12 month TT Precedents Club membership period, unless you choose to renew or join the TT Precedents Club at a future date.
Is the Testamentary Trusts: The Essential Guide for Australian Lawyers course suitable for someone who does not currently do testamentary trust wills?
The course is perfect for someone who doesn’t currently prepare testamentary trust wills.
I wrote it to help you understand the core foundational legal principles behind TTs, and then we go through all the practical will drafting and client strategy guidance you need to get comfortable with strategizing and drafting.
It’s the complete guide to get you feeling comfortable with TTs.
Please note the course doesn’t include testamentary trust precedents, but it will help you feel confident with using them once you get them.
How do I watch the Testamentary Trusts: The Essential Guide for Australian Lawyers course?
When you join, you get access to the Art of Estate Planning portal, which is hosted in Kajabi.
There are two ways to access the training videos:
- on the 'big screen' through your computer
- on your phone through our app (a great option if you want to upskill while on your walk, cleaning, gardening etc!)
Is it tax deductible?
Yes. We recommend you talk to your accountant to be safe (this isn't tax advice ;)
Can I get CPD points for the Testamentary Trusts: The Essential Guide for Australian Lawyers course and the TT Precedents Club Hot Seats?
Each State has different criteria for solicitors claiming CPD points. Below is a summary of the relevant guidelines from each State:
Queensland: In Queensland you can self assess your CPD points. Courses, Workshops, Lectures and Discussion Groups and Web-Based Programs are eligible for CPD points on the basis of 1 CPD point per hour, and there is no limit on the hours that can be undertaken in this format. See the QLS CPD Guide.
Victoria and New South Wales: In Victoria and New South Wales you can self assess your CPD points. Private study of recorded audio/visual materials (which is passive and does not offer opportunity for interaction) is also eligible for CPD points on the basis of 1 CPD point per hour, however you cannot claim more than 5 CPD points for this activity per year See the Legal Profession Uniform Continuing Professional Development (Solicitors) Rules 2015 .
South Australia: In South Australia you can self assess your CPD points. Viewing a web-based program or recorded material is eligible for CPD points on the basis of 1 CPD point per hour, however you cannot claim more than 5 CPD points for this activity per year. Australian Capital Territory: In the ACT you can self assess your CPD points. Workshops, lectures, tutorials, discussion groups, audio/video/online presentations are eligible for CPD points on the basis of 1 CPD point per hour, and there is no limit on the hours that can be undertaken in this format. Tasmania: In Tasmania you can self assess your CPD points. Viewing a web-based program or recorded material is also eligible for CPD points on the basis of 1 CPD point per hour, however you cannot claim more than 5 CPD points for this activity per year. Northern Territory: In the NT you can self assess your CPD points. Private study using audio or visual material is also eligible for CPD points on the basis of 0.5 CPD points per 30 minutes however you cannot claim more than 5 CPD points for this activity per year. Western Australia: In the WA your CPD must be from an authorised provider. The Art of Estate Planning is registered as an authorised provider with the WA Legal Practice Board (ID 41714) however only for our weekly hot seat calls in The TT Precedents Club.
At this point in time you will not receive CPD points for completing the online course.
